JungleSMS.com is an online service that allows our members to send sponsored SMS messages from our website and a unique software application downloaded to your mobile/cell phone. JungleSMS members will be given an allocation of free sponsored SMS messages per month to send to any mobile/cell phone any where in the world. Member will be able to earn or buy more messages on the site. Members can earn more sponsored SMS by taking part in marketing campaigns from our carefully selected marketing partners.

JungleSMS members will also be able to send unlimited member to member messages "jungle chat" from the website or through the software application downloaded to their mobile/cell phone handset. JungleSMS members can view each others' profile; communicate with other member by adding them to their online phonebook. The online phone book will be mirrored on the software application that sits on you mobile/cell phone.

1.Acceptance of terms
JungleSMS.com provides its service to you subject to the following Terms of Use. Your affirmative act of using JungleSMS.com signifies that you agree to the following Terms of Use. If you do not accept and abide by these Terms of Use, you may not use the JungleSMS.com service. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time. Any such change, modification, addition, or deletion will be effective upon thirty (30) calendar days following our dispatch of an internet SMS notice to you or following our posting of such notice on JungleSMS.com Web site. You can review the most current version of the Terms of Use at any time on this page. If you do not agree to changes of the Terms of Use, then you must stop using the JungleSMS.com service. If you continue to use JungleSMS.com after we post changes to these Terms of Use, you are signifying your acceptance of the new terms.

2. Description of Service
JungleSMS.com is a free website and software application that allows users who have registered on our site to send SMS either from our website or a downloadable free software application anywhere in the world free of charge: JungleSMS.com does not charge anything. (The "Service"). Customer/member that subscribes to buy and send additional SMS messages from either our website or through the downloaded free software application will be charged according to the subscribed additional SMS tariff. You understand and agree that the Service will include advertisements, as described hereunder and in the JungleSMS.com Privacy Notice and that these advertisements or other related information are necessary for JungleSMS.com to provide the Service. Unless explicitly stated otherwise by JungleSMS.com in the following Terms of Use, any new features that augment or enhance the current Service, including the release of new JungleSMS.com properties, shall be subject to the Terms of Use. You understand and agree that the Service is provided "as-is" and that JungleSMS.com disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Service. JungleSMS.com also reserves the right to modify, suspend or discontinue the Service with or without notice at any time and without any liability to you. You are responsible for obtaining access to the Service, and that access may involve third-party fees (such as Internet service provider or telecoms operator charges). In addition, you must provide and are responsible for all equipment necessary to access the Service.

3. Personal use
The Service is made available to you for your personal use only. You shall not, shall not agree to, and shall not authorize or encourage any third party to: (i) use the Service to upload, transmit or otherwise distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as reasonably determined by JungleSMS.com; (ii) upload, transmit or otherwise distribute content that infringes upon another party's intellectual property rights or other proprietary, contractual or fiduciary rights or obligations; (iii) prevent others from using the Service; or (iv) use the Service for any fraudulent or inappropriate purpose, such as distribution of unsolicited or unauthorized material, including junk mail," "spam," "chain letters," "pyramid schemes", or distribution of viruses, worms, defects, Trojan horses, corrupted files or any other items of a destructive or deceptive nature. Violation of any of the foregoing may result in immediate termination of the Service, and may subject you to penalties and other legal consequences. You acknowledge, consent and agree that JungleSMS.com may access, preserve and disclose your account information and content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms of Use; (c) respond to claims that any content violates the rights of third parties; (d) respond to your requests for customer service; or (e) protect the rights, property or personal safety of JungleSMS.com, its users and the public. You understand that by using the Service, you may be exposed to content issued by third parties that is offensive, indecent or objectionable. Under no circumstances will JungleSMS.com be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via the Service, nor does JungleSMS.com have any obligation to monitor such third party content.

You also agree that you will not use any robot, spider, other automated device, or manual process to monitor or copy any content from the Service. JungleSMS.com grants you a personal, non-transferable and non-exclusive right and license to use the object code of its Software on a single mobile phone; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work from, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by JungleSMS.com for use in accessing the Service. The JungleSMS.com trademarks and service marks and other JungleSMS.com logos and product and service names are trademarks of Wolf Ltd/SponsoredSMS.com (the "JungleSMS.com Marks"). Without wolf Ltd/SponsoredSMS.com prior permission, you agree not to display or use in any manner the JungleSMS.com Marks.

The Service may provide, or third parties may provide, links to World Wide Web sites or resources. Because JungleSMS.com has no control over such sites and resources, you acknowledge and agree that JungleSMS.com is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that JungleSMS.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

8. Indemnification
You agree to indemnify and hold JungleSMS.com and its subsidiaries, affiliates, officers, agents, employees, partners and licensors (each, a �JungleSMS.com party�, and collectively, the �JungleSMS.com parties�) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Use, or your violation of any rights of another.

9. Representations and Warranties
You represent and warrant that (a) all of the information provided by you to JungleSMS.com to participate in the Services is correct and current; and (b) you have all necessary right, power and authority to enter into this agreement and to perform the acts required of you hereunder. Failure to provide JungleSMS.com, upon its request, with all necessary justifying documents, may entitle JungleSMS.com to terminate your JungleSMS.com account and access to the Service.

10. Disclaimer of warranties
You expressly understand and agree that, to the maximum extent permitted by applicable law:
a) The Service is provided on an "as is" and "as available" basis. The JungleSMS.com parties disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement;
b) The JungleSMS.com parties make no warranty that (i) the Service will meet your requirements, (ii) the Service will be uninterrupted, timely, secure or error-free, and (iii) any errors in the Software will be corrected;
c) Any material downloaded or otherwise obtained through the use of the Service is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

11. Limitation of liability
In no event will any JungleSMS.com party be liable for any damages, including without limitation any indirect, consequential, special, incidental damages arising out of, based on or resulting from these Terms of Use or your use of the Service, even if such JungleSMS.com party has been advised of the possibility of such damages. These limitations and exclusions apply without regard to whether the damages arise from (i) breach of contract, (ii) breach of warranty, (iii) negligence or (iv) any other cause of action; to the extent such exclusions and limitations are not prohibited by applicable law. Whatever the cause or damage when using the Service, JungleSMS.com will assume responsibility only up to 200 pound sterling.

12. Termination
You may cancel your use of the Services and/or terminate the Service with or without cause at any time. You only have to uninstall the JungleSMS.com application by following the uninstall instructions for Java applications in your mobile phone manual. You agree that JungleSMS.com may, under certain circumstances and without prior notice, immediately terminate your JungleSMS.com account and access to the Service. Cause for such termination shall include, but not be limited to, (a) breaches or violations of the Terms of Use or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) discontinuance or material modification to the Service, (d) unexpected technical or security issues or problems, (e) extended periods of inactivity or (f) engagement by you in fraudulent or illegal activities. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account although residual copies of information may remain in our system. Sections 4, 6, 10, 11 and 12 of the Terms of Use shall survive expiration or termination.
